Biden Administration’s Asylum Transit Ban 

Biden Administration announced a list of policy changes at the border, including publishing a new proposed rule. The proposed rule would bar asylum for any person who had not previously applied for asylum in a third transit country before reaching the United States, as well as those who cross the border illegally.

The rule would apply only to asylum seekers who, after Title 42 ends and in the two-year period after the rule goes into effect, enter the US southern border without proper documentation and travel through a country that is a signatory to the 1951 Refugee Convention or its 1967 Protocol.

The migrants who would not comply with the rule would be ineligible for asylum except in certain cases.
