On March 27, 2023, USCIS formally announced that they had received enough registrations to reach the FY 2024 H-1B cap and that the selection process had been completed. However, USCIS has not yet publicly released the total number of registrations, or the number of registrations selected for processing. Registrations can have different status classifications, including “Submitted,” “Selected,” “Denied,” or “Invalidated – Failed Payment,” and at the end of the fiscal year, unused “Submitted” registrations will be changed to “Not Selected.”
Also, USCIS started accepting H-1B cap-subject petitions since April 1, 2023, for beneficiaries named in valid “Selected” registrations. The Registration Selection Notice indicates the Beneficiary Confirmation Number and is only valid for the company and beneficiary listed on the notice. The notice also indicates a specific 90-day filing window and the designated Service Center location where the petitioner must file the H-1B petition. For H-1B registrations selected in March 2023, the filing period is April 1, 2023, to June 30, 2023. It is important to note that the designated Service Center for filing the FY2024 H-1B cap-subject petition is assigned by USCIS on the Registration Selection Notice and not based on the location of employer or employment. Petitions will be adjudicated in the order in which they are received.
