DOS posted the visa bulletin for October 2022. USCIS determined that for October 2022, all family-sponsored preference categories must use the Dates for Filing chart in the Visa Bulletin and all employment-based preference categories must use the Final Action Dates chart. According to October 2022 visa bulletin, visa numbers will still be current for Second preference (F2A) – spouses and children (unmarried and under 21 years of age) of lawful permanent residents. On the other hand, the Final Action Dates chart shows that visa numbers are current for EB-1, EB-2, and EB-3 (skilled workers and professionals) employment-based petitions and the priority date for EB-3 (other workers) is June 1, 2020. This means the workers who have no degree and less than 2 years of experience can file an Adjustment of Status application only if their priority date is earlier than June 1, 2020.
