Online Filing Option for Certain I-765 Categories

Agencies verifying the eligibility of applicants for benefits are frequently presented with an I-765 Employment Authorization Document (EAD). To assist agencies in determining the applicant’s eligibility, they refer to some specific EAD category codes and the provisions of the federal regulations. (c)(11) is one of those categories. Aliens paroled into the United States in the public interest or temporarily for emergency reasons are eligible to file employment authorization under this category. USCIS announced that certain parolees can now file for I-765 Employment Authorization Application online with limited exceptions. Applicants seeking a waiver of the filing fee or those eligible for a fee exemption, such as Afghan nationals paroled through Operation Allies Welcome and filing an initial Form I-765, will continue to submit Form I-765 by mail. Eligible applicants must first visit my.uscis.gov to create a USCIS online account to file the I-765 online. If an applicant submits Form I-765 online to request employment authorization but is not filing under an eligible employment authorization category, USCIS may deny the application and may not return the filing fee.
