Lawsuit Filed Against Trump Administration’s Birthright Citizenship Executive Order

On January 23, 2025, the lawsuit was officially filed in the United States District Court for the Western District of Washington, highlighting the severe constitutional conflicts posed by the order and seeking an immediate injunction to halt its enforcement. Immigrants’ rights organizations have initiated legal action against the Trump Administration in response to an executive order aimed at denying U.S. citizenship to certain babies born on American soil. The lawsuit asserts that this order violates the Constitution, disregards congressional intent, and contravenes longstanding Supreme Court precedent. The case, brought forward by groups such as the ACLU, ACLU chapters in New Hampshire, Maine, and Massachusetts, Asian Law Caucus, State Democracy Defenders Fund, and Legal Defense Fund, represents organizations whose members could be directly impacted. Plaintiffs include New Hampshire Indonesian Community Support, League of United Latin American Citizens (LULAC), and Make the Road New York. The lawsuit challenges the administration’s attempt to redefine constitutional protections of citizenship for children born in the United States.
