The H-1B classification has an annual numerical limit (cap) of 65,000 new statuses/visas each fiscal year. An additional 20,000 petitions filed on behalf of beneficiaries with a master’s degree or higher from a U.S. institution of higher education are exempt from the cap.
On August 23, 2022, USCIS announced that it reached H-1B Cap for FY2023. That means USCIS received enough H-1B cap petitions to fill the 85.000 available slots for the fiscal year. USCIS has completed sending non-selection notifications to registrants’ online accounts. The status for registrations properly submitted for the FY 2022 H-1B numerical allocations, but that were not selected, will now show as “Not selected”.
USCIS will continue to accept and process petitions for those who are otherwise cap-exempt or who have already been counted previously against the cap.
